My practice is 100% devoted to Washington’s cyclists and cycling advocacy. If you are involved in a bike versus car, bike versus bike, bike versus pothole, bike versus dog or similar incident, the last thing you want to do, in addition to dealing with your injuries, is wade through the quagmire of legal and insurance issues.

Having accumulated 30 years of legal experience and a lifetime of cycling experience I will be able to guide you through what would otherwise be a confusing and aggravating process. We are here to step in on your behalf to ensure that you are treated fairly and are fully compensated for your losses. I employ a top-notch legal team that has successfully handled hundreds of bicycle related incidents ranging from property damage claims to multimillion dollar injury claims. Once my team is involved, your primary concern will be attending to your injuries and recovery while we handle the insurance and legal issues.

In a majority of bicycle versus car situations, it is not unusual for the car’s insurance company to immediately blame the cyclist. Despite these tactics, in my experience the car driver is almost always 100% at fault for causing the unfortunate crash. It is important to get my office involved as early as possible so that we can obtain and preserve evidence such as police reports, investigative materials, injury photos, and witness statements.

In order to avoid collection actions, it is vital to immediately sort out who is responsible for your medical bills. Regardless of who is at fault for the incident, if you are hit by a car while cycling, the vehicle’s Personal Injury Protection (PIP) policy is the primary payer for at least $10,000 of your medical bills. Although it seems counterintuitive, your automobile PIP policy is next in line to pay your medical bills and your health insurance is in third place. Juggling multiple different insurance companies can be confusing but my office will set up your PIP claims and work with the insurance companies so that your treatment bills are paid. Additionally, most cyclists are unaware that their own automobile Underinsured Motorist (UIM) policy provides coverage while they are riding their bicycle.

When my office handles your case, all communication with the insurance companies is directed to us so that you are able to focus on your recovery and getting back to the activities you enjoy. Ride safely!

"Just wanted to say Thank You for all your hard work and dedication to my case. When I first got injured right after the crash I had no plans to hire an attorney.

My wife advised me to consider it and so I posted an inquiry to some of my fellow riders on the Cascade website. I remember I got a reply within hours and someone said 'call John Duggan he’s the best!’

The next time someone asks me about a cycling attorney I know what I’ll say 'call John Duggan, he’s the best!' Again, thank you so much."
